Facts:   The consumer purchased a new 2022 Cadillac Escalade in May of 2022. In October the engine started making noise and subsequently with only 6,000 miles on it, the engine seized without being able to be repaired. The manufacturer agreed to replace the engine, but the consumer was told the car would be out of service for months and no loaner car would be provided. The consumer was compelled to purchase another vehicle, given the high cost of renting and no date of completion and no loaner cars available at Cadillac.
Verdict:   Consumer then retained Anthony T. Ballato in October 2022 and a demand letter was served on the manufacturer pursuant to the Lemon Law. Mr. Ballato negotiated a repurchase of the vehicle for the full value of $100,281.75 as well as $4,000.00 in legal fees from General Motors LLC in April 2023, after much correspondence with staff attorneys. All sales tax being refunded by separate application to NYS Tax Department.
