Facts:   On December 19, 2020, claimant leased a new 2021 Jeep Grand Cherokee from Huntington Chrysler Dodge Jeep Ram. Claimant brought the vehicle in for service because the vehicle kept stalling out when in drive. Claimant alleges while driving the vehicle in April 2021, the vehicle kept “stalling out”. In June of 2021, Claimant alleges the same issue happened with the car “stalling out” while driving. Claimant brought the vehicle back for service and it was determined that the engine was malfunctioning and burning too much oil. The engine was replaced. In August 2021, Claimant again brought the vehicle back for service again due to the vehicle “bucking, jerking and stalling.” The claimant was told there was nothing wrong with her vehicle and that it was safe to drive.
Verdict:   After 3 attempts to fix the vehicle and over 41 days out of service, the consumer hired Anthony Ballato, Esq. to represent her. Mr. Ballato sent a letter to FCA US LLC demanding they repurchase the consumers’ vehicle. After extensive conversations and emails with the manufacturer’s attorney’s representative, James Anderson, Case Manager at Rose Waldorf PLLC, in Albany, New York, the manufacturer settled. The manufacturer repurchased the vehicle, cancelled the lease and returned all lease payments in the amount of $7,095.91 to the consumer plus legal fees in the amount of $2,500.00.
