Facts:   On April 8, 2015, claimant Nehemias Mercedes leased a new 2015 Mercedes GLA45 from Mercedes-Benz of Massapequa. On February 18, 2016, the claimant alleges that while driving the vehicle the engine shut off and would not start. On February 19, 2016, the claimant had the car towed to a Mercedes-Benz dealership in Reading, PA. The car had only 6,356 miles on it. The vehicle was out of service for 34 days. On March 28, 2016 claimant brought the vehicle back to the dealership because the left rear bumper melted due to Turbo Over boost which ultimately caused engine failure. On April 6, 2016 the claimant brought the vehicle back in for service for the same thing. The rear bumper melted due to a defective Turbo.
Injury:   The technician confirmed that the car would not start. The technician checked for fault codes – there were no current codes. When the engine did start it sounded like the timing was off. There was a large amount of oil leaking into the intake area and the Turbo Shaft Play was out of specs. The plugs were also filled with oil. Metal shavings were found in the oil pickup tube and oil pan. Mercedes Benz advised the technician to replace the complete engine assy and turbo assembly. The front module and bumper were removed and replaced. The bumper was replaced and the axel was resecured.
Verdict:   After numerous attempts to fix the vehicle and over 45 days out of service, the claimant hired Anthony Ballato, Esq. to represent him. Mr. Ballato sent a demand letter to Mercedes-Benz USA, LLC demanding the claimant’s money back or a new vehicle of equal value. After several conversations and emails with the Manufacturer, the case was settled. The manufacturer repurchased the vehicle in the amount of $66,711.37 including $2,500 in legal fees.
