Facts:   On September 26, 2017, Consumer Kathleen Friedman, leased a new 2017 Audi A4 from Legend Autorama LTD, Amityville, New York. While the consumer was on vacation, they had to have the vehicle towed to Kinney Motors in Vermont for service alleging that the check engine light was on, the auto stop malfunction, vehicle lights malfunction, drive system malfunction and parking brake malfunction. The technician found that the battery lost charge. Once again, the same lights came on while the consumer was on vacation. The car had to be towed back to Kinney Motors for service. This time the car advised customer to have vehicle towed in. The car was towed from Kinney Motor in Vermont to Audi of Massapequa, Massapequa, New York for repair. The technicians found that the gateway module electrical was defective. The gateway module was replaced.
Verdict:   After multiple attempts to fix the vehicle and over 69 days out of service, the consumer hired Anthony T. Ballato, Esq. of Massapequa, NY to represent her. Mr. Ballato sent a demand letter to the manufacturer Audi of America demanding that they repurchase the consumer’s vehicle pursuant to Notice Pursuant to New Car Lemon Law; New York General Business Law Article 11-A, Sections 198-A, Et Seq.; Notice of Revocation of Acceptance and Demand for Rescission Uniform Commercial Code Article 2; Claims Under Manufacturer’s Warranties and Magnusson-Moss Warranty Act; and Demand for all Sales, Financing and Service Documents. After numerous conversations, correspondence and emails with Nicole B. of Audi of America, she advised the Manufacturer would settle the matter. The manufacturer later agreed to replace the vehicle with a new 2019 Audi Q5, with the consumer contributing $2,730.00 for the upgraded vehicle and pay legal fees in the amount of $1,500.00.
