Facts:   In 2015 David Pickow purchased a new 2016 Hyundai Tucson from Auto Mall Hyundai d/b/a Atlantic Hyundai. The consumer alleged that he was deceived and not given the typical sales contract nor bill of sale at the time of purchase nor any documents until several requests long thereafter. The consumer felt confused, misled and grossly overcharged as well as later discovered upon consulting Anthony T. Ballato, Esq. that he was charged thousands of dollars for add-ons that he did not want, such as an extended warranty of $2,500 (despite Hyundai having the best and longest warranty in the industry) and $1,800 for prepaid maintenance, etc., and being charged about $2,381 over the sticker price of $28,670 without realizing any of this at the time of purchase. After a series of letters and negotiations with the dealer’s attorney, John Gentile, Esq. and the General Manager, Jason Montalvo, Mr. Ballato was successful in negotiating a refund to the consumer of $6,900 in addition to cancellations and refunds of the unwanted extended warranty and prepaid maintenance of $4,300 (totaling $11,200 returned to the consumer) including legal fees.
