Case Type:   Lemon Law, Motor Vehicle
Case:   Devine v. Hyundai America
Date:   July 18, 2013
Plaintiff Attorney(s):   Anthony T. Ballato, Esq., Massapequa, NY
Defendant Attorney(s):   Manufacturer’s House Counsel
Facts:   The consumer purchased a new 2013 Hyundai Genesis. The consumer received a standard warranty. Two months after purchasing the Hyundai, the consumer reported problems with the Vehicle, in that over five (5) different dates he brought the vehicle in for repairs of the ignition and the electrical problems and the vehicle was out of service for over thirty (30) days. Consumer states that the vehicle had chronic problems with ignition / no start of engine / electrical problems. The consumer brought the car to the dealership to have these problems corrected five (5) times within five (5) months which exceeded the New Car Lemon Law (GBL Article 11-A) threshold of four (4) repair attempts and/or thirty (30) days out of service during the first two (2) years months/18,000 miles. The consumer’s efforts to compel return of the vehicle were denied and he therefore retained Anthony T. Ballato, Esq. to negotiate a settlement or commence a Lemon Law proceeding, which resulted in a full credit towards a new replacement vehicle plus consumer’s legal fees.
Verdict:   Brand new replacement vehicle, depreciation has been waived and attorney’s fees of $1,750.00.
