Facts:   On September 19, 2015, Consumer John Sodano, purchased a new 2015 Cadillac Escalade from Sarant Cadillac Corp., of Farmingdale, New York. On December 7, 2015 the Consumer brought the vehicle in for service alleging that when it is cold the transmission slips in reverse gear. The consumer also alleged that the exhaust makes a whistling noise. On June 20, 2016 the consumer brought the vehicle back in for service alleging that the same problem still exists. On July 25, 2016 the consumer brought the vehicle in for service for the same problem. The transmission was banging. The technician removed the transmission. The pump sprocket had stripped metal throughout the unit. The transmission had to be overhauled and flushed. On January 3, 2017 the consumer brought the vehicle back in for service alleging that the transmission is slipping. The technician updated the program. On April 3, 2017 the consumer brought the vehicle in for service alleging that the transmission slams into gear and is erratic. On May 8, 2017 the consumer brought the vehicle in for service alleging that the transmission is slipping at all speeds and that the vehicle will not move after sitting for a long period of time. The technician contacted case 8-2952696411 and they authorized to replace the transmission for the second time.
Verdict:   After several attempts to fix the vehicle the consumer decided to file for an Arbitration Hearing with the New York Attorney General. On September 13, 2017 the New York Attorney General accepted the case and a hearing date was scheduled for October 2, 2017 in Hempstead, New York. On September 12, 2017 the consumer hired Anthony Ballato, Esq. to represent him at the Hearing. On September 12, 2017 Mr. Ballato contacted Bryan Taylor of the Rose Waldorf Firm to advise him that he is representing the consumer at the hearing. After several telephone calls and correspondence with Bryan Taylor, Esq. and Jayne Radzyminski of the Rose Firm on September 25, 2017 the manufacturer offered to repurchase the vehicle for the total cost of $72,525.70.
