Facts:   The consumer purchased a new 2007 Ford Mustang Saleen S281 Stage I Supercharged Sports Car in March, 2007. The consumer received a standard warranty from both Ford and Saleen. One (1) month after purchasing the car, the consumer reported problems with the vehicle, in that on two (2) different dates he brought the vehicle in for repair. Consumer states that the vehicle had chronic engine problems and would fail to start, which was a material impairment of value. The consumer brought the car to the dealership to have these problems corrected twice within one (1) year and for over seventy (70) days, which exceeded the New Car Lemon Law (GBL Article 11-A) threshold of four (4) repair attempts and/or thirty (30) days out of service during the first twenty-four months/18,000 miles. The consumer’s efforts to compel return of the vehicle were denied and he therefore retained Anthony T. Ballato to negotiate a settlement or commence a Lemon Law proceeding. Efforts by counsel to negotiate a settlement for the full replacement value of the used 2007 Ford Mustang Saleen S281 Stage I Supercharged Sports Car for a new 2008 Ford Mustang Saleen S281 Stage III Supercharged Sports Car were successful after the commencement of a Lemon Law proceeding via the Office of the New York State Attorney General.
